(“Competition”)
Terms and Conditions
- Information on how to enter and the prizes forms part of the terms and conditions of entry. Participation in the Competition is deemed acceptance of these terms and conditions.
- The promoter is Maxwell International Australia (“Promoter”)
- The sponsor is South African Tourism (“Sponsors”)
- Subject to clauses 5,6 and 7 below, entry is open to residents of Australia.
- Each entry to the “Tamron Purchase” sector (outlined in clause 12) of the competition must have proof of purchase of a Tamron lens dated within the competition period (outlined in clause 8) in order to be eligible for the set of “Tamron Purchase” prizes. Proof of purchase must be endorsed by an authorized Australian Retailer of Tamron products (“receipt”).
- Entrants must be 18 years or older.
- Employees of the Promoter and their immediate family members, the Sponsors and any of their associated agencies, suppliers or related bodies corporate are not eligible to enter this Competition.
- The Competition commences on 14/11/11 at 00:01 (AEDT) and concludes on 29/02/12 at 23:59 (AEDT). No responsibility is accepted for late, lost or misdirected entries.
THE COMPETITION MECHANISM
- During the competition period submissions will be accepted via the competition page www.tamron.com.au/shoottothrill.
- Users will be required to register a unique email address and their personal details in order to make a submission.
- Submissions can be made in either of two competition sectors:
- Photo Competition sector – available to all eligible entrants (defined in clauses 5-8)
- Tamron Purchase sector – available ONLY to purchasers of Tamron lenses during the competition period.
- A submission to the Photo Competition sector will contain a single uploaded photograph and a brief description explaining their photograph as their interpretation of “shoot to thrill”.
- Any photograph submitted must be the entrant’s own work, with the user explicitly owning the copyright to the submitted photograph.
- Users will be required to register a unique email address and their personal details in order to vote for their favourite submissions within the Photo Competition sector
- Each user created will be granted two votes, which must both be awarded in order to successfully tally their contribution.
- The winner of the Photo Competition Major Prizes will be determined by the five (5) submissions with the largest number of votes at the completion of the competition period.
- The winner of the Photo Competition Minor Prizes will be determined by the twenty (20) submissions with the largest number of votes following the top five (5) submissions with the largest number of votes.
- The winner of the Photo Competition Supplementary Prizes will be determined by the eight hundred (800) submissions with the largest number of votes following the top twenty-five (25) submissions with the largest number of votes. The number of Photo Competition Supplementary Prizes may be increased in order to uphold the 1:5 Prize:Submission ratio in the Photo Competition sector.
- A submission to the Tamron Purchase sector will contain one (1) statement of 25 words or less outlining “Why you find photography thrilling”.
- The winner of the Tamron Purchase sector prizes (Tamron Purchase Grand Prize, Tamron Purchase Major Prize, Tamron Purchase Minor Prize, and Tamron Purchase Supplementary Prize) will be determined by the most creative answers as determined as per the organizer’s (marketing team) discretion. Judges decisions are final and no correspondence shall be entered into.
- The top one (1) creative answer will be awarded the Tamron Purchase Grand Prize.
- The next ten (10) creative answers will be awarded a Tamron Purchase Major Prize.
- The next forty (40) creative answers will be awarded a Tamron Purchase Minor Prize.
- The next four hundred (400) creative answers will be awarded a Tamron Purchase Supplementary Prize. The number of Tamron Purchase Supplementary Prizes may be increased in order to uphold the 1:5 Prize:Submission ratio in the Tamron Purchase sector.
- Winners will be announced no later than March 16th, 2012 via the competition website.
- Winners will also be notified in writing via email
THE COMPETITION PRIZES
- There is one (1) Tamron Purchase Grand Prize (“holiday”) to be awarded to one (1) entrant in the Tamron Purchase sector of the competition. The holiday winner chosen will be awarded the following package: see attachment (prizes).
- The winner of the holiday and his/her travelling companion must depart from the same airport on the same flight. Subject to paragraph 11 below, the winner and his/her travelling companion are responsible for transport from their residence to the nearest Flight Departure City.
- If the winner of the holiday resides in Tasmania, the ACT or the Northern Territory, connecting flights from the winner’s nearest capital city to the nearest Flight Departure City will be provided for the winner and travelling companion only.
- The total holiday prize value is approximately AU$20,000 per couple(including GST). Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
- The holiday must be booked, ticketed and taken on the specified dates and times.
- The holiday must be taken between 1 April 2012 and 31 March 2013. Blackout dates 15 December – 15 January 2013. Please note South African Tourism requires a minimum of 8 weeks’ notice prior to the dates winners wish to travel.
- If for any reason whatsoever the winner of the holiday is unable to take any element of the prize at the time specified by the Promoter, then that element of the prize in its entirety will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
- The holiday winner and his/her travel companion are responsible for all other expenses including, without limitation, spending money, meals, transfers, activities (unless specified), incidentals, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.
- Frequent flyer or other reward program points are not available in relation to any element of the holiday.
- Accommodation selection, location and room type and air carrier selection and routing is at the sole discretion of the Promoter and the Sponsors.
- The traveller’s must ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.
- The Promoter and the Sponsors make no representation as to the safety, conditions or other issues that may exist at any destination.
- There are ten (10) Tamron Purchase Major Prizes to be awarded to ten (10) entrants in the Tamron Purchase sector of the competition. The winners chosen will be awarded the following package: see attachment (prizes)
- The total Tamron Purchase Major Prize pool value is approximately $1,690. Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
- There are forty (40) Tamron Purchase Minor Prizes to be awarded to forty (40) entrants in the Tamron Purchase sector of the competition. The winners chosen will be awarded the following package: see attachment (prizes)
- The total Tamron Purchase Minor Prize pool value is approximately $2,798. Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
- There are at least four hundred (400) Tamron Purchase Supplementary Prizes to be awarded to at least four hundred (400) entrants in the Tamron Purchase sector of the competition. The winners chosen will be awarded the following package: see attachment (prizes)
- The total Tamron Purchase Supplementary Prize pool value is at least $11,996. Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
- There are five (5) Photo Competition Major Prizes to be awarded to five (5) entrants in the Competition. The winners chosen will be awarded the following package: see attachment (prizes).
- The total Photo Competition Major Prize pool value is approximately $4,245. Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
- There are twenty (20) Photo Competition Minor Prizes to be awarded to twenty (20) entrants in the Competition. The winners chosen will be awarded the following package: see attachment (prizes).
- The total backpack prize pool value is approximately AU$5,980 (including GST). Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
- There are at least eight hundred (800) Photo Competition Supplementary Prizes to be awarded to at least four hundred (800) entrants in the Photo Competition sector of the competition. The winners chosen will be awarded the following package: see attachment (prizes)
- The total Photo Competition Supplementary Prize pool value is at least $23,992. Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
- All prizes are not transferable to another individual and is not exchangeable or redeemable for cash, goods or services. The prize is not refundable. The prize winner cannot change, vary, substitute or extend any element of the prize (in whole or in part).
- The Promoter, the Sponsors and their associated agencies, and other contractors associated with this Competition accept no responsibility for prizes lost in transit.
- The Promoter accepts no responsibility for any tax implications that may arise from any prize winnings. Independent financial advice should be sought.
- To the extent permitted by law and any direction of the relevant gaming authority, if any prizes are unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
OTHER DETAILS
- If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.
- If a winning entry is deemed by the Promoter not to comply with these conditions of entry, the entry will be discarded and a new winner of the prize will be determined from those entries eligible to receive the prize.
- Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid.
- If an entrant’s contact details change during the promotional period, the entrant must promptly notify the Promoter of the relevant change. A request to access or modify any information provided in an entry should be in writing and directed to Promoter.
- The decision of the Promoter in relation to the conduct of the Competition and the prize winner is binding and final and the Promoter will not enter into any correspondence regarding the Competition result.
- The Promoter reserves the right to require the winner to provide proof of identification and/or proof of residency or address details in order to claim the prize. Proof of identification, residency and address considered suitable for verification is at the discretion of the Promoter. If a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute or cash will be awarded in lieu of the prize.
- The Promoter reserves the right to disqualify any entry which, in the opinion of the Promoter, contains objectionable content, profanity, potentially insulting, or defamatory statements or if the entry does not comply with these Terms and Conditions. The Promoter also reserves the right to, in its sole discretion; disqualify any entrant whom the Promoter believes has tampered with the entry process or has engaged in conduct in relation to the Competition that the Promoter believes to be fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter.
- The prize winner must comply with all the conditions of use of the prize and the prize supplier's requirements. The prize winner and his/her travelling companion may also be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
- To the extent permitted by law, no responsibility will be accepted by the Promoter, the Sponsors, their related bodies corporate, employees, or suppliers to the Promoter (together the “Parties”) for any late, lost or misdirected entries or for any claim arising from the conduct of the Competition. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
- To the extent permitted by law, the Parties and its associated agencies and companies associated with this Competition, will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, misadventure, accident, personal injury, death, damage or claim which is suffered or sustained (whether or not arising from any person’s negligence) in connection with:
- undertaking any travel connected with the Competition or any prize won;
- any act or omission (whether negligent or not) of the Parties, or any person associated with any of them; or
- due to circumstances outside the Parties’ reasonable control.
- To the extent permitted by law, if for any reason this Competition is not capable of running as planned, due to causes including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the competition, and recommence it from the start on the same conditions subject to any government regulation.
- In the case of the intervention of any outside person or event which changes the result or prevents or hinders the determination of the Competition, including but not limited to vandalism, power failures, tempests, acts of terrorism, natural disasters, civil unrest, strikes or any other event beyond the control of the Promoter; the Promoter may in its discretion cancel, terminate, modify or suspend the Competition and recommence it from the start on the same conditions subject to any government regulation.
- All entry details become the property of the Promoter. To facilitate your participation, the Promoter may disclose your personal information to other companies associated with this promotion. If the information requested is not provided, you may not enter this promotion. By entering the Competition, unless otherwise advised, each entrant acknowledges and agrees that they consent to the Promoter and the Sponsors collecting their personal information and that the entrant consents to the Promoter and the Sponsors using such information for future promotional and marketing activities including, without limitation, sending the entrant electronic messages.
- If an individual no longer consents to their details being used for promotion and marketing purposes, the entrant should contact the Promoter or relevant Sponsor (whichever the case may be.
- By accepting the major prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
- In consideration for the Promoter awarding a prize to the winner the winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
- It is the each entrant’s responsibility, where necessary, to obtain appropriate written permission from the people who appear in their images. Winning entrants must be able to provide written evidence of this consent, if required.
- AUTOMATIC OPT-IN: By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter and benefiting parties (South African Tourism) may use this information, in any media, for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
- STANDARD OPT-IN: All entries become the property of The Promoter and benefiting parties (South African Tourism) All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
